The Marvellous Musical Machine: Licence Agreement

In order for your work to be included in The Marvellous Musical Machine project, we need you to enter into a legally binding Licence Agreement with us, Digital Writes – Development and Publishing C.I.C.

You will retain all copyright in the work you create, and you will assert your moral rights, including those to paternity and integrity.

This means you will keep ownership of the work you produce, and anyone who uses it must credit you as the creator. It also means that no one can alter your work or use it in a way that could damage your reputation.

By entering into this agreement, you grant us a licence to use your work. A licence means that you are giving us permission to use your work in specific ways, but you still own your work.

If you are under 18, a parent or carer will need to give their permission for you to enter into this agreement.

Key Terms

“The Project”

The Marvellous Musical Machine is a fun and creative project where you and your peers will work together to create unique musical machines using everyday objects and simple technology. You’ll have the opportunity to contribute as much or as little as you like — from sharing ideas to building and designing instruments or even helping with the final showcase.

This means that anything you create or help with as part of the project will be covered by the agreement, no matter how big or small your contribution.

During the project, you will:

  • Learn the basics of physical computing and coding (like using micro:bits)
  • Explore and experiment with found objects to make interesting sounds
  • Work in small groups to come up with ideas and solve creative challenges
  • Draw or make early versions (prototypes) of your musical machines
  • Build and design your own homemade musical instruments
  • Write simple code to make your instruments play sounds, chords, or tunes
  • Test and improve your instruments to make them work better
  • Work with others to create music or sound compositions using your instruments
  • Reflect on your work by talking about it, drawing, or writing about it
  • (Optional) Share your musical machines in informal presentations to teachers, parents, or classmates
  • (Optional) Appear in short videos showing how the instruments were made and played
  • (Optional) Help document the project, for example by taking photos, writing captions, or creating displays for a final showcase

“Your Contribution”:

“Your Contribution” is any work created by you as an active participant (“The Contributor”) in The Marvellous Musical Machine project, whether made on your own or in collaboration with other participants and/or Digital Writes tutors or assistants and/or teachers or teaching assistants. This includes, but is not limited to:

  • Ideas, designs, or suggestions related to musical instruments or the project as a whole
  • Sketches, drawings, or diagrams for instruments or project materials
  • Coding or programming for musical machines or related systems
  • Construction or modification of physical instruments
  • Sound exploration, composition, and performance using musical machines
  • Written reflections, notes, journals, or labels created during the project
  • Contributions to group compositions or soundscapes
  • Appearance in still photographs, videos, or audio recordings
  • Assisting with how-to guides, teaching resources, or documentation
  • Any administrative, creative, technical, or promotional work you do as part of your participation in the project

The Agreement

This is a legally binding Licence Agreement between Digital Writes – Development and Publishing C.I.C., of 10 Alveston Close, Westlea, Swindon SN5 7DE (Company Number: 9740449), and you, the Contributor.

Terms and Conditions

(These are a more rigorously legal expression of the terms above.)

  1. Copyright Licence:
    I grant Digital Writes – Development and Publishing C.I.C. a non-exclusive, perpetual, irrevocable, royalty-free licence (with the right to give permission to others) to use, adapt, copy, share, and distribute my Contribution in any way they think is appropriate. This includes using it in The Marvellous Musical Machine project and in any teaching resources, websites, videos, publications, exhibitions, performances, or future creative or educational projects connected with it.
  2. No Payment:
    I understand that I will not be paid for my Contribution. I understand that Digital Writes is a not-for-profit organisation, and that any income from the project will contribute towards running costs and future educational or creative activities.
  3. Moral Rights:
    I confirm that I keep my moral rights to be credited as the author of my work, and to object if it is changed in a way that could damage my reputation, or if something I didn’t create is wrongly attributed to me.
  4. Safety and LiabilityI understand that Digital Writes is not responsible for any loss, damage, or injury to me or my property, unless it is directly caused by their negligence.
  5. No Guarantee of Use
    I understand that Digital Writes does not have to use my Contribution, and that it may not be included in the final version of The Marvellous Musical Machine or any related materials.
  6. My Responsibility for My Contribution
    I confirm that my Contribution does not copy anyone else’s work without permission, and does not include anything illegal, offensive, or harmful. If something I create accidentally turns out to be defamatory, Digital Writes agrees not to hold me responsible unless I included it with negligence or bad intent.
  7. Understanding the Agreement
    I confirm that I have read this agreement and that I understand what I am agreeing to.
  8. Governing Law
    This agreement is made under the laws of England, and any legal matters will be decided by the courts of England.

GDPR Compliance

In compliance with UK GDPR, Digital Writes will retain a copy of this contract for legal and copyright purposes for an indefinite period. If you have submitted a hard copy of this form, we will scan and digitise it for our records and securely destroy the original paper copy.

For your protection, we will ensure that all digital copies of this agreement are encrypted and stored securely. We also commit to protecting your personal data and ensuring that it is processed in a manner that guarantees its confidentiality and security.

You have the right to access, correct, or request the deletion of your personal data at any time. If you have any concerns about how your personal data is handled, please contact us at privacy@digitalwrites.org.uk
